• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT ON THE SITE;
• WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
• WARRANTIES REGARDING THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE; AND
• WARRANTIES REGARDING THE QUALITY, SAFETY, OR SUITABILITY OF ANY FOOD OR BEVERAGE PRODUCTS FOR ANY PARTICULAR DIETARY NEED OR HEALTH CONDITION (BEYOND WHAT IS DISCLOSED ON OUR ALLERGEN INFORMATION).

Some jurisdictions do not allow the exclusion of certain warranties; therefore, some of the above exclusions may not apply to you. In such cases, our warranties shall be limited to the fullest extent permitted by applicable law.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JET'S PIZZA & GRILL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY:

THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

The foregoing limitations shall apply to the fullest extent permitted by applicable law in the applicable jurisdiction. Some states do not allow the limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

8. Indemnification

You agree to defend, indemnify, and hold harmless Jet's Pizza & Grill, its parent company (if any), subsidiaries, affiliates, officers, directors, shareholders, employees, contractors, agents, licensors, service providers, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

1. Your violation of these Terms of Service;
2. Your use of the Site or our services in a manner inconsistent with these Terms;
3. Your violation of any applicable local, state, federal, or international law or regulation;
4. Your infringement of any intellectual property right, privacy right, or other right of any third party;

9. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Jet's Pizza & Grill operates, without regard to its conflict of law principles.

For matters involving consumer protection, we acknowledge the applicability of the Federal Trade Commission Act (15 U.S.C. § 41 et seq.), which prohibits unfair or deceptive acts or practices in commerce. We are committed to full compliance with all applicable federal consumer protection regulations enforced by the Federal Trade Commission (FTC).

For customers located in the State of California, we acknowledge the additional protections afforded by the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA) (Cal. Civ. Code § 1798.100 et seq.), and the California Unfair Competition Law (Cal. Bus. & Prof. Code § 17200 et seq.).

Any legal action or proceeding arising under or in connection with these Terms that is not subject to arbitration shall be brought exclusively in the federal or state courts of competent jurisdiction located in the United States. You hereby irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection to such jurisdiction or venue.

10. Dispute Resolution

10.1 Informal Resolution

10.2 Binding Arbitration

If the parties are unable to resolve a dispute through informal means, and except as provided below, you and Jet's Pizza & Grill agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or our services (including any question of the existence, validity, or termination of these Terms) shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in English and in the United States. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Notwithstanding the foregoing arbitration agreement, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the completion of arbitration. Additionally, claims arising under applicable small claims court rules may be brought in small claims court rather than through arbitration.

10.5 Arbitration Fees

The allocation of arbitration fees shall be governed by the AAA Consumer Arbitration Rules. If you are a consumer initiating arbitration for a claim of less than $10,000, we will pay all AAA arbitration filing fees and arbitrator fees, unless the arbitrator finds your claim was frivolous or improper.
